Official Rules
THE BAILEY BLUE INSTAGRAM CONTEST (THE “CONTEST”) IS INTENDED FOR PLAY IN THE UNITED STATES ONLY AND SHALL BE CONSTRUED AND EVALUATED ACCORDING TO UNITED STATES LAW. DO NOT ENTER THIS CONTEST IF YOU ARE NOT LOCATED IN THE UNITED STATES AT THE TIME OF ENTRY. NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

How to Enter: No purchase necessary to enter the Contest. This Contest starts at 12:00 pm PST August 9th, 2017 and ends at 12:00 pm PST on August 14th, 2017. To enter: (i) follow @baileyblueclothing; (ii) tag three friends in the comments. All online entrants must have a valid Instagram account in good standing and able to receive direct messaging. The account holder of the Instagram account associated with any entry establishes the identity of the entrant and ultimately, who the winner will be. Any effort by an entrant to misrepresent themselves through the use of aliases and fake or multiple accounts will disqualify entries of that entrant. Only one (1) entry permitted per person. By participating, all entrants agree to abide by these Official Rules.
Eligibility: The Contest is open to residents of the United States, excluding Puerto Rico and Guam. This giveaway is void wherever prohibited by federal, state, provincial, municipal or local laws. You must be eighteen (18) or older to enter this Contest to be eligible to win. Employees and immediate families or household members of Sponsor and their respective parent companies, affiliates and subsidiaries, are ineligible to participate in this giveaway.
Winner Selection and Notification: The winner of the Prize will be selected by Sponsor, in a random drawing of all eligible entries received. The odds of winning are determined by the number of eligible entries received. Entries will be deemed to have been submitted by Authorized Account Holder of the
Instagram account associated with the entry. “Authorized Account Holder” is defined as the natural person who is assigned the Instagram account used to submit the entry. The winner selection will be conducted under the supervision of Sponsor. The decision of Sponsor is final and binding in all matters relating to this giveaway. Entries are property of the Sponsor and will not be returned. Winner will be notified by Instagram direct messaging. Sponsor shall not be liable for (i) failed, returned or misdirected notifications based on inaccurate information provided by the winner; or (ii) entries, and responses to winner notifications which are lost, late, incomplete, illegible, unintelligible, misdirected, damaged or otherwise not received by the intended recipient in whole or in part or for computer or technical error of any kind.
Winner will be given three (3) business days from the first day of notification to respond to claim prize. A non-response by the winner or non-receipt of notification response after the specified three (3) business days will be considered winner’s forfeiture of the prize and an alternate winner may, at the sole election of Sponsor, be selected from the pool of eligible entries. At the sole and absolute discretion of Sponsor, winners may be required to complete and return an Affidavit of Eligibility and Liability/Publicity Release as a condition of acceptable of a prize.
Prizes: For this giveaway, there will be (1) prize awarded nationally in the United
States, as follows: a top of choice from www.baileyblueclothing.com. The winner shall be responsible and liable for all federal, state and local taxes on the value of the prize.
General Conditions: This giveaway is void where prohibited by law and is subject to all applicable federal, state and local laws and regulations. In the event of non-compliance by the winner with these Official Rules, an alternate winner may be awarded the prize. The prize is non-transferable. The prize may not be substituted for cash, except that Sponsor reserves the right to substitute a prize of equal or greater value if the prize is unavailable. Return of the prize or prize notification as undeliverable will result in disqualification and an alternate winner may, at Sponsor’s sole election, be selected. Any submission that is considered by Sponsor in its sole and absolute discretion to be obscene, pornographic, libelous, hate speech or otherwise objectionable, in whole or in part, will be disqualified and will not be eligible for entry. All requested information on the Contest page must be completed to enter and to be eligible to win. Except as otherwise contemplated in these Official Rules, and to the extent entrants may otherwise elect at the time of entry, personal information collected in connection with the Contest will be used in accordance with the online privacy policy available at the website. Any communication or information transmitted to Sponsor or the website by e-mail or otherwise is and will be treated as non-confidential and non-proprietary. Proof of submission is not considered proof of delivery to or receipt of such entry. Furthermore, Sponsor shall have no liability for any Submission that is lost, intercepted or not received by Sponsor. Sponsor is the official time keeper for the Contest. All entry information and materials, including any copy of the submission submitted to Sponsor, become the property of Sponsor and will not be acknowledged or returned. Except where legally prohibited, acceptance of any prize constitutes permission for Sponsor to use the winner’s name, photograph, likeness, voice, address (city and state) and testimonials in printed, broadcast or new media, in perpetuity, in any manner Sponsor deems appropriate in connection with promoting this or any other giveaway and/or promotion sponsored by Sponsor, without further compensation in connection with this giveaway or the prize awarded.
Verification of Winners: Potential winners may be required to execute an affidavit of eligibility, liability release, and/or a publicity release. If any potential winner fails or refuses to sign and return all such requested documents within seven (7) days of prize notification, the winner may be disqualified and an alternate winner may be selected. Releases: By participating, entrants agree that Sponsor, those involved in the development, production (including prize suppliers), implementation and distribution of this promotion and its parent companies, affiliates, subsidiaries, service providers and agencies, and their directors, officers, agents, employees, attorneys, and any other person or entity associated with such entities and/or promotion (collectively, “Sponsor Parties”) shall not be liable for any and all claims, damages, losses or injuries, including any third party claims, arising from or relating, in whole or in part, to this giveaway, including entry and participation in this giveaway and acceptance, possession, use or misuse of the prize. All entrants further agree that in the event of any third party claims, damages, losses or injuries arising from or relating to this giveaway, they will indemnify Sponsor Parties from any and all such claims, including the attorneys’ fees related thereto. Sponsor Parties shall not be liable for entries and winner notification responses that are delayed, lost, misdirected, mis-delivered, marked postage-due, illegible, mutilated, incorrect or incomplete, and such entries will not be eligible for this giveaway. Sponsor shall not be responsible for any technical malfunction of the telephone network, computer online system, computer equipment, software, program malfunctions or other failures, delayed computer transactions or network connections that are human, mechanical or technical in nature, or any combination thereof, including any injury or damage to entrant’s or any other person’s computer related to or resulting from downloading any part of this giveaway. Any person attempting to defraud or in any way tamper with this giveaway will be ineligible for the prize and may be prosecuted to the full extent of the law. Sponsor reserves the right, in its sole discretion, to cancel or suspend this giveaway should viruses, bugs or other causes beyond its control corrupt the administration, security or proper play of the giveaway. This giveaway shall be governed by California law.
By participating in this giveaway, entrants agree that California courts shall have jurisdiction over any dispute or litigation arising from or relating to this giveaway and that venue shall be only in Los Angeles, California. Per Instagram rules we must mention that this is in no way sponsored, administered, or associated with Instagram. By entering entrants confirm that they are 18 years of age, release Instagram of responsibility, and agree to Instagram’s term of use.
